What is a Notice of Removal?

A notice of removal is a notice that a defendant must file, along with other required documents, to remove an action from state to federal court. It must be filed in a United States District Court for the district within which the action is pending. The eligibility of an action for removal is governed by statute and federal caselaw, the nature of the claims alleged and the amount in controversy are both relevant to an action’s eligibility for removal.
