What is a Declaration?

An affidavit or declaration is sworn, written evidence provided by witnesses. Most jurisdictions, including the United States District Court, require that affidavits and declarations be made on personal knowledge and set forth facts that would be admissible in evidence. Affidavits and declarations must also establish the testimonial competence of the affiant/declarant and be signed under penalty of perjury.
