Affidavits Required for Certain Motions

Affidavits are required, under Connecticut rules in many specific circumstances, and the rules frequently specify the required contents of the affidavit. Always consult any specific rules pertaining to the pleading or paper at issue, and the applicable SmartRules™ procedural guide, before proceeding. Affidavits are filed with the court and should therefore follow the same format specified for motions, pleadings and other court-filed documents.

Caption

Connecticut does not proscribe detailed format requirements for case captions in its statutes and rules. As a matter of custom and practice, however, papers filed with the court are captioned with the name of the court and judicial district at the top and center of the first page. The caption typically then displays the name of the plaintiff(s) and defendant(s) at left, with the case number to the right, and the title of the pleading or other paper below the case number or centered below the remainder of the caption. This standard format is delineated in Form PB 101, contained in the Appendix to the Connecticut Practice Book.
