Virginia Dismiss
An opposition to a motion to dismiss requests that the court find the pleading at issue to be sufficient. An opposition to a motion to dismiss must show the court that the pleading at issue is legally sufficient, or may be amended, and therefore should not be dismissed. A motion to dismiss is confined to the four corners of the complaint, or other pleading at issue, so legal arguments, and not evidence, are presented in both the moving and opposing papers. SmartRules Virginia simplifies the rules for complying with codes, rules of court, civil procedure and local court rules, in a single search. SmartRules covers pleadings, timing, format, motion practice, subpoenas, filing and service.
