Virginia Demurrer
An opposition to a demurrer requests that the court find the pleading at issue to be sufficient. An opposition or response to a demurrer must state the reasons why the pleading to which the demurrer was addressed is legally sufficient, or may be amended, and therefore should survive dismissal. A demurrer is confined to the four corners of the complaint, or other pleading at issue, so legal arguments, and not evidence, are presented in both the moving and opposing papers.
