Virginia Compel Discovery
A motion to compel discovery is a motion brought by a party asking the court to compel another party, or third party, to provide certain disclosures or discovery. In most jurisdictions, a motion to compel must be made on notice to other parties and all affected persons. Additionally, in most jurisdictions, a motion to compel discovery must include a certification that the movant has in good faith conferred or attempted to confer with the person or party failing to make disclosure or discovery in an effort to obtain the contested discovery without court action.
