Reconsideration
An opposition to a motion to reconsider requests that the court uphold its previous ruling on a matter. The opposition will usually argue that the moving party is simply trying to reargue facts and theories upon which a court has already ruled. A successful opposition will show that there has been no intervening change of controlling law, new evidence, or clear legal error that would necessitate a different ruling. Opposition papers are usually supported by a statement of facts, a legal brief or memorandum with citations to legal authority, and if necessary, exhibits, declarations, and affidavits.
