File Under Seal
A motion to file under seal requests that the court order that certain documents in a lawsuit are not available for public inspection, but are only available to limited persons for a limited time in connection with the lawsuit. The information that parties seek to protect often includes business records and other business documents produced by parties on the basis that they constitute trade secrets and access to these could assist competitors and jeopardize business interests. Additionally, parties often seek to protect personal financial and medical records. The moving party must usually show that there exists an overriding interest in the confidentiality of the information that overcomes the right of public access to the record.
